On October 12, 2023, a ruling on a preliminary submission about the motion for the presiding judge to disqualify herself from the case will be made by the Accra High Court hearing Dr. Ato Forson and two other defendants.
Dr. Forson informed the court presided over by Justice Afia Serwah Asare-Botwe that they submitted the application on June 29, 2023, asking the trial judge to recuse herself due to bias against the accused. Dr. Forson was represented by Dr. Abdul Aziz Bamba.
Dr. Bamba claimed that the court had inherent jurisdiction over the application and that the trial judge lacked the qualifications to continue hearing the case.
The attorney claimed that the application related to some of the judge’s pre-jurisdictional remarks and statements.
